FREQUENTLY ASKED QUESTIONS

What can a workers compensation lawyer do for me?

A lot. South Carolina has  a system designed to prevent an injured worker from losing what he already has if unable to work. The injured worker is to be given free medical treatment to lessen the period of disability so he/she can return to their job. Many injuries require surgery, physical therapy, etc. This can take weeks to months for recovery. All the medical treatment should be paid for by the insurance company and the worker gets a weekly check for 2/3 of their average weekly wage. Most importantly the injured worker will have permanent impairment or may not be able to return to their job. They are entitled to be compensated for this in a fair amount. Without an experienced and aggressive attorney all the above rights simply will not be offered to an injured worker.

How do I choose a lawyer?

First, call him and make an appointment. The sooner the better. Our first meeting is free. You cant hire a good attorney on the phone. Sit down with the lawyer and look him in the eye and ask all the questions you have. Make sure you are comfortable with his answers and have the lawyer explain everything he can do to help you. Ask about experience, results and what you can expect from the lawyer. If you are not pleased with his answers or uncomfortable with him, go speak with someone else until you find the right fit.

Can a personal injury lawyer really get me more money?

Without question. After 26 years of practicing personal injury law it still surprises me that some people still believe they will be compensated fairly if they are, for example, injured in a automobile accident. The truth is the money is to be paid by the insurance company, not the driver. The insurance adjusters and their lawyers  have one goal, to NOT pay any money or to pay as little as they possibly can to end the claim. They are on nobodies side but their own and could care less about your damaged car, your medical bills, your lost wages, and the pain you have had to endure now and possibly in the future. They only protect THEIR rights. Its imperative you use your own lawyer to protect YOUR rights. In every case I have handled over 26 years I have collected anywhere from 2 to 10 or more times the money the insurance company first offered my client.

Is an arrest for a crime the same as a conviction?

No. An Arrest is only an formal accusation made by the police or a person that you have committed a crime. You still are innocent unless there is sufficient evidence to convict you and if the police have followed the proper procedure in arresting you. You have many rights that protect you if you are accused of a crime that most people dont even know about. Many people make the  mistake of believing that they are guilty merely because they get arrested. We will be glad to explain your rights to you.
